1. Responsable del tratamiento y definiciones

  1. El responsable del tratamiento de los datos personales de los Clientes y Usuarios de la Tienda online, también denominado Vendedor, es FORCETOP Sp. z o.o., teléfono +48 690 007 776, número fiscal polaco (NIP) 6182072303, REGON 300726319.
  2. Puede contactarse con el Responsable por correo postal en Chotów 24 B, 63-460 Chotów, Polonia o por correo electrónico en sklep@crong.com.
  3. Usuario: persona física que accede al sitio de la Tienda online o utiliza los servicios y funciones descritos en esta Política.
  4. Cliente: persona física con plena capacidad jurídica, consumidor, persona jurídica o entidad a la que la ley reconoce capacidad jurídica, que celebra un contrato de compraventa a distancia con el Vendedor.
  5. Tienda online: sitio web gestionado por el Vendedor en https://crong.com, a través del cual pueden consultarse los productos y su disponibilidad, comprarlos o contratar servicios.
  6. Boletín (Newsletter): información, incluidas comunicaciones comerciales según la Ley polaca de 18 de julio de 2002 sobre servicios prestados por vía electrónica (Diario de Leyes de Polonia 2020, posición 344), enviada electrónicamente por el Vendedor. Su recepción es voluntaria y exige consentimiento.
  7. Cuenta: conjunto de datos almacenados en la Tienda y los sistemas informáticos del Vendedor sobre el Cliente/Usuario, sus pedidos y contratos, que permite realizar pedidos y celebrar contratos.
  8. RGPD: Reglamento (UE) 2016/679, de 27 de abril de 2016, relativo a la protección de las personas físicas respecto del tratamiento de datos personales y a la libre circulación de estos datos, por el que se deroga la Directiva 95/46/CE.

2. Fines, bases jurídicas y duración del tratamiento

  1. Para ejecutar un contrato de compraventa a distancia, el Vendedor trata: (a) información necesaria para el funcionamiento del servicio, como la dirección IP, cookies y tecnologías similares, datos de sesión, navegador, dispositivo y actividad en las distintas páginas; (b) datos de geolocalización, si el Usuario lo autoriza, para presentar ofertas más adecuadas; y (c) datos necesarios para comprar, como nombre y apellidos, domicilio de la empresa y dirección postal, correo electrónico, teléfono, NIP, número de cuenta bancaria y otros datos exigidos durante el pedido.
  2. La información técnica no identifica necesariamente por sí sola al Usuario, pero combinada con otros datos puede constituir información personal y queda protegida por el RGPD.
  3. El tratamiento para prestar servicios electrónicos con arreglo a las Condiciones de la Tienda se basa en el artículo 6.1.b) del RGPD. En su caso, el tratamiento consentido de determinadas cookies, tecnologías similares o la geolocalización se fundamenta en el artículo 6.1.a) del RGPD. El consentimiento expresado mediante la configuración del navegador se contempla conforme a la legislación polaca de telecomunicaciones. Los datos se tratan hasta la finalización del uso de la Tienda.
  4. El Responsable aplica las medidas técnicas y organizativas apropiadas conforme al artículo 32 del RGPD, teniendo en cuenta los avances técnicos, costes, naturaleza, alcance y fines del tratamiento y la probabilidad y gravedad de los riesgos para los derechos y libertades de las personas.

3. Actividades comerciales del Responsable

  1. El Responsable puede mostrar información promocional sobre sus productos o servicios en la Tienda. La base indicada es su interés legítimo según el artículo 6.1.f) del RGPD en comunicar sus servicios y promociones. Esta información responde a las expectativas habituales de los visitantes y no vulnera sus derechos y libertades.

4. Destinatarios de los datos

  1. Los datos personales se facilitan a encargados del tratamiento sujetos a los correspondientes contratos para servicios como alojamiento web, mantenimiento de la página, asistencia informática, marketing y relaciones públicas.

5. Transferencias a terceros países

  1. Los datos personales no se tratarán en terceros países.

6. Derechos de las personas interesadas

  1. Toda persona interesada tiene derecho:
    1. De acceso (art. 15 RGPD): confirmar si se tratan sus datos, acceder a ellos e informarse sobre fines, categorías, destinatarios, plazo de conservación o criterios aplicables y derechos de rectificación, supresión, limitación y oposición.
    2. A obtener una copia (art. 15.3): la primera copia es gratuita; por copias adicionales podrá cobrarse una cantidad razonable basada en costes administrativos.
    3. De rectificación (art. 16): corregir datos inexactos y completar los incompletos.
    4. De supresión (art. 17): solicitar la eliminación cuando ya no exista fundamento jurídico o los datos dejen de ser necesarios para los fines previstos.
    5. De limitación (art. 18): cuando (a) se impugna la exactitud durante su verificación; (b) el tratamiento es ilícito, pero se solicita limitarlo en vez de suprimirlo; (c) el Responsable ya no necesita los datos, pero la persona los precisa para reclamaciones; o (d) se ha presentado oposición mientras se verifican los motivos legítimos prevalentes.
    6. A la portabilidad (art. 20): recibir los datos proporcionados en formato estructurado, de uso común y lectura mecánica, y solicitar su transmisión a otro responsable cuando el tratamiento sea automatizado y se base en el consentimiento o un contrato.
    7. De oposición (art. 21): por motivos relacionados con su situación particular frente a tratamientos basados en intereses legítimos, incluida la elaboración de perfiles. El Responsable valorará si existen motivos legítimos imperiosos o necesidades de defensa de reclamaciones que prevalezcan; de no ser así, cesará el tratamiento.
    8. A retirar el consentimiento: en cualquier momento y sin justificación, sin afectar a la licitud del tratamiento anterior; el tratamiento basado en dicho consentimiento terminará.
  2. Para ejercer estos derechos debe contactarse con el Responsable indicando el derecho y el alcance de la solicitud.

7. Autoridad polaca de protección de datos

  1. Puede presentarse una reclamación ante la autoridad de control competente. En Polonia es el Presidente de la Oficina de Protección de Datos Personales (Prezes UODO), ul. Stanisława Moniuszki 1A, 00-014 Varsovia, Polonia.

8. Delegado de Protección de Datos

  1. También es posible contactar directamente con el delegado de protección de datos del Responsable por correo electrónico o postal mediante los datos del apartado 1, punto 2.

9. Modificaciones de la Política

  1. La Política de privacidad y cookies podrá completarse o actualizarse según las necesidades del Responsable para ofrecer información fiable y actualizada a Clientes y Usuarios.

  1. La Tienda obtiene información sobre Clientes, Usuarios y su comportamiento a través de (a) datos introducidos voluntariamente en formularios para sus fines específicos, (b) cookies almacenadas en dispositivos y (c) registros del servidor web recogidos por el proveedor de alojamiento para el funcionamiento del sitio.
  2. Las cookies son archivos de datos, habitualmente de texto, almacenados en el dispositivo; suelen contener el nombre del sitio de origen, un plazo de conservación y un identificador único.
  3. La Política describe el consentimiento previo para usar cookies y considera que pulsar «Cerrar» o cerrar el aviso implica consentir todas las cookies.

11. Boletín (Newsletter)

  1. El Cliente puede consentir recibir comunicaciones comerciales electrónicas durante el registro o posteriormente desde la Cuenta. Recibirá el Newsletter y otras comunicaciones del Vendedor en el correo indicado.
  2. La baja puede solicitarse en cualquier momento en la Cuenta, en https://crong.com/es/newsletter.html, mediante el enlace de cada boletín o a través de atención al cliente.

12. Cuenta

  1. Clientes y Usuarios no pueden publicar ni remitir contenido ilícito, incluidas opiniones u otros datos.
  2. El acceso a la Cuenta se concede tras registrarse.
  3. Durante el registro se facilitan tipo de cuenta o sexo, nombre y apellidos, empresa, NIP, datos de facturación y entrega, correo electrónico y contraseña, garantizando su veracidad. Deben leerse y aceptarse las Condiciones generales.
  4. Al activarse la Cuenta se celebra un contrato indefinido de servicios electrónicos; el consumidor puede desistir según las Condiciones generales.
  5. La Cuenta creada en una versión de la Tienda permite acceder a las demás versiones.
  6. El Cliente/Usuario puede resolver dicho contrato en cualquier momento con efecto inmediato por correo electrónico o postal dirigido a los contactos del apartado 1, punto 2.
  7. El Vendedor puede resolver el contrato si interrumpe o transfiere a un tercero el servicio, se vulnera la ley o las Condiciones generales o la Cuenta permanece inactiva seis meses, con siete días de preaviso. El Vendedor podrá exigir autorización para un nuevo registro.
