Privacy policy

1. Data controller and definitions

  1. The controller of the personal data of Customers and Users of the Online Store (also referred to as the Seller) is FORCETOP Sp. z o.o., telephone +48 690 007 776, Polish tax identification number (NIP) 6182072303, REGON 300726319.
  2. The Controller may be contacted in writing at Chotów 24 B, 63-460 Chotów, Poland, or by email at sklep@crong.com.
  3. User means an individual visiting the Online Store's website or using the services or features described in this Privacy and Cookies Policy.
  4. Customer means an individual with full legal capacity, a consumer, a legal person or an organisational unit granted legal capacity by law, who concludes a distance sales agreement with the Seller.
  5. Online Store means the website operated by the Seller at https://crong.com, through which Customers and Users can learn about goods and their availability, purchase goods or order services.
  6. Newsletter means information, including commercial information within the meaning of the Polish Act of 18 July 2002 on the Provision of Services by Electronic Means (Journal of Laws 2020, item 344), sent electronically by the Seller. Subscribing is voluntary and requires consent.
  7. Account means a collection of data stored in the Online Store and the Seller's IT systems relating to a Customer/User, their orders and agreements, enabling them to place orders and conclude agreements.
  8. GDPR means Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC.

2. Purposes, legal bases and duration of processing

  1. In order to perform a distance sales agreement, the Seller processes: (a) device and service-operation information, including IP address, cookies and similar technologies, session, browser, device and activity data (including visits to individual subpages); (b) geolocation information if the User consents, in order to offer more relevant products and services; and (c) personal information needed to complete a purchase, including first and last name, business and correspondence addresses, email, telephone number, NIP, bank account number and any other information required during checkout.
  2. Device information does not necessarily identify a User on its own but may constitute personal data when combined with other information; the Controller therefore protects it under the GDPR.
  3. Processing for the provision of electronic services under the Store Terms is based on Article 6(1)(b) GDPR. Where applicable, processing resulting from consent to specific cookies, similar technologies or geolocation is based on Article 6(1)(a) GDPR. The policy refers to consent expressed through browser settings in accordance with Polish telecommunications law. These data are processed until the Customer/User stops using the Online Store.
  4. The Controller undertakes to implement technical and organisational measures appropriate to the risk, as required by Article 32 GDPR, taking account of the state of the art, implementation costs, the nature, scope and purposes of processing and the likelihood and severity of risks to individuals' rights and freedoms.

3. Controller's marketing activities

  1. The Controller may display marketing information about its products or services in the Online Store, relying on its legitimate interest under Article 6(1)(f) GDPR in publishing information relating to its services and promotions in which it participates. These activities do not infringe Customers' or Users' rights and freedoms, as such content may reasonably be expected during a visit to the Store.

4. Recipients of Users' data

  1. The Controller discloses Users' personal data to service providers acting as processors under data-processing agreements, for the provision of services such as hosting, website operation, IT support, marketing and public relations.

5. Transfers of personal data to third countries

  1. Personal data will not be processed in third countries.

6. Rights of data subjects

  1. Every data subject has the following rights:
    1. Access (Article 15 GDPR): to obtain confirmation of whether their data are being processed, access to the data and information on the purposes, categories, recipients, retention period or its criteria, and the rights to rectification, erasure, restriction and objection.
    2. A copy (Article 15(3) GDPR): to receive a copy of the data being processed; the first copy is free of charge, and a reasonable administrative fee may be charged for further copies.
    3. Rectification (Article 16 GDPR): to have inaccurate personal data corrected and incomplete data completed.
    4. Erasure (Article 17 GDPR): to request deletion where there is no longer a legal basis for processing or the data are no longer necessary for the processing purposes.
    5. Restriction (Article 18 GDPR): to restrict processing where (a) accuracy is contested, for the period required for verification; (b) processing is unlawful but the individual requests restriction rather than erasure; (c) the Controller no longer needs the data but the individual requires them for legal claims; or (d) an objection has been submitted, pending verification of whether the Controller's legitimate grounds prevail.
    6. Data portability (Article 20 GDPR): to receive the data provided to the Controller in a structured, commonly used, machine-readable format and request transmission to another controller where processing is automated and based on consent or a contract.
    7. Objection (Article 21 GDPR): to object, on grounds relating to their particular situation, to processing based on legitimate interests, including profiling. The Controller then assesses whether overriding legitimate grounds or the establishment, exercise or defence of legal claims justify continued processing; otherwise it must stop processing for those purposes.
    8. Withdrawal of consent: to withdraw consent at any time without giving reasons, without affecting the lawfulness of processing carried out before withdrawal; processing based on that consent then ceases.
  2. To exercise these rights, contact the Controller using the contact details above, specifying the right concerned and the scope of the request.

7. President of the Personal Data Protection Office

  1. Data subjects may lodge a complaint with the competent supervisory authority. In Poland, this is the President of the Personal Data Protection Office (Prezes UODO), ul. Stanisława Moniuszki 1A, 00-014 Warsaw, Poland.
  2. Contact is possible by post at the address above, via https://uodo.gov.pl/pl/p/kontakt, or through the helpline 606-950-000.

8. Data Protection Officer

  1. Data subjects may also contact the Controller's Data Protection Officer directly by email or in writing using the Controller's contact information in Section 1(2).

9. Amendments to this policy

  1. This Privacy and Cookies Policy may be supplemented or updated as required by the Controller to provide Customers and Users with up-to-date and reliable information.

10. Cookies

  1. The Online Store collects information about Customers, Users and their behaviour through (a) information voluntarily entered into forms for the purposes of those forms, (b) cookies saved on end devices, and (c) web-server logs collected by the Store's hosting provider to ensure the website operates properly.
  2. Cookies are data files, usually text files, stored on the Customer's or User's device. They typically contain the website name, an expiry or storage period and a unique identifier.
  3. The Store uses cookies after receiving the User's prior consent; it describes consenting to all cookies by selecting “Close” on the cookie message or closing the message.
  4. The Store also provides an “I do not agree” option or changing browser settings to refuse cookies; restrictions may prevent some website functions from working correctly.
  5. Cookie preferences can be managed in the settings of the relevant browser or operating system, including Chrome, Safari, Firefox, Opera and mobile browsers.
  6. The policy identifies the Controller's legitimate interest in ensuring service quality and security as a legal basis for certain cookie-related processing.
  7. Two main cookie types are used: session cookies, removed when the User logs out, leaves the Store or closes the browser, and persistent cookies, stored until their stated expiry or manual deletion.
