Πολιτική απορρήτου

1. Υπεύθυνος επεξεργασίας και ορισμοί

  1. Υπεύθυνος επεξεργασίας των προσωπικών δεδομένων των Πελατών και Χρηστών του Ηλεκτρονικού Καταστήματος, ο οποίος αναφέρεται και ως Πωλητής, είναι η FORCETOP Sp. z o.o., τηλέφωνο +48 690 007 776, πολωνικός φορολογικός αριθμός (NIP) 6182072303, REGON 300726319.

  3. Χρήστης είναι το φυσικό πρόσωπο που επισκέπτεται τον ιστότοπο του Καταστήματος ή χρησιμοποιεί τις υπηρεσίες και λειτουργίες που περιγράφονται στην παρούσα Πολιτική.
  4. Πελάτης είναι φυσικό πρόσωπο με πλήρη δικαιοπρακτική ικανότητα, καταναλωτής, νομικό πρόσωπο ή οργανωτική μονάδα στην οποία ο νόμος αναγνωρίζει δικαιοπρακτική ικανότητα και η οποία συνάπτει σύμβαση πώλησης εξ αποστάσεως με τον Πωλητή.
  5. Ηλεκτρονικό Κατάστημα είναι ο ιστότοπος που λειτουργεί ο Πωλητής στη διεύθυνση https://crong.com, μέσω του οποίου παρέχονται πληροφορίες σχετικά με τα προϊόντα και τη διαθεσιμότητά τους και μπορούν να πραγματοποιηθούν αγορές ή παραγγελίες υπηρεσιών.
  6. Ενημερωτικό δελτίο (Newsletter) είναι οι πληροφορίες, συμπεριλαμβανομένων εμπορικών μηνυμάτων κατά την πολωνική νομοθεσία της 18ης Ιουλίου 2002 για την παροχή υπηρεσιών με ηλεκτρονικά μέσα (Εφημερίδα της Κυβερνήσεως της Πολωνίας 2020, θέση 344), που αποστέλλει ηλεκτρονικά ο Πωλητής. Η εγγραφή είναι προαιρετική και απαιτεί συγκατάθεση.
  7. Λογαριασμός είναι το σύνολο των δεδομένων του Πελάτη/Χρήστη, των παραγγελιών και συμβάσεών του, που τηρούνται στο Κατάστημα και στα πληροφοριακά συστήματα του Πωλητή και του επιτρέπουν να πραγματοποιεί παραγγελίες και να συνάπτει συμβάσεις.
  8. ΓΚΠΔ (GDPR) είναι ο Κανονισμός (ΕΕ) 2016/679 της 27ης Απριλίου 2016 για την προστασία φυσικών προσώπων έναντι της επεξεργασίας δεδομένων προσωπικού χαρακτήρα και την ελεύθερη κυκλοφορία τους, με τον οποίο καταργήθηκε η οδηγία 95/46/ΕΚ.

2. Σκοποί, νομικές βάσεις και διάρκεια επεξεργασίας

  1. Για την εκτέλεση σύμβασης πώλησης εξ αποστάσεως ο Πωλητής επεξεργάζεται: (α) τεχνικές πληροφορίες για την ορθή λειτουργία των υπηρεσιών, όπως διεύθυνση IP, cookies και συναφείς τεχνολογίες, δεδομένα συνεδρίας, προγράμματος περιήγησης, συσκευής και δραστηριότητας στις επιμέρους σελίδες· (β) δεδομένα γεωεντοπισμού, εφόσον υπάρχει συγκατάθεση, για πιο κατάλληλες προσφορές· (γ) δεδομένα αναγκαία για την αγορά, όπως ονοματεπώνυμο, επαγγελματική και ταχυδρομική διεύθυνση, email, τηλέφωνο, NIP, τραπεζικός λογαριασμός και λοιπές πληροφορίες που ζητούνται κατά την ολοκλήρωση της παραγγελίας.
  2. Τα τεχνικά στοιχεία δεν ταυτοποιούν απαραιτήτως από μόνα τους τον Χρήστη, αλλά ενδέχεται να αποτελούν προσωπικά δεδομένα σε συνδυασμό με άλλες πληροφορίες και προστατεύονται σύμφωνα με τον ΓΚΠΔ.
  3. Η παροχή ηλεκτρονικών υπηρεσιών σύμφωνα με τους Όρους του Καταστήματος βασίζεται στο άρθρο 6 παρ. 1 στοιχ. β΄ ΓΚΠΔ. Όπου απαιτείται, η επεξεργασία βάσει συγκατάθεσης για συγκεκριμένα cookies, παρόμοιες τεχνολογίες ή γεωεντοπισμό βασίζεται στο άρθρο 6 παρ. 1 στοιχ. α΄ ΓΚΠΔ. Η συγκατάθεση μέσω των ρυθμίσεων του προγράμματος περιήγησης εξετάζεται σύμφωνα με το πολωνικό τηλεπικοινωνιακό δίκαιο. Τα δεδομένα τηρούνται έως τη λήξη της χρήσης του Καταστήματος.
  4. Ο Υπεύθυνος εφαρμόζει κατάλληλα τεχνικά και οργανωτικά μέτρα σύμφωνα με το άρθρο 32 ΓΚΠΔ, λαμβάνοντας υπόψη την τεχνολογική εξέλιξη, το κόστος, τη φύση, την έκταση και τους σκοπούς της επεξεργασίας και την πιθανότητα και σοβαρότητα των κινδύνων για τα δικαιώματα και τις ελευθερίες των φυσικών προσώπων.

3. Δραστηριότητες μάρκετινγκ

  1. Ο Υπεύθυνος δύναται να δημοσιεύει στο Κατάστημα πληροφορίες προώθησης των προϊόντων και υπηρεσιών του. Ως βάση αναφέρεται το έννομο συμφέρον του άρθρου 6 παρ. 1 στοιχ. στ΄ ΓΚΠΔ για την προβολή των υπηρεσιών και των προωθητικών ενεργειών. Το περιεχόμενο αυτό θεωρείται αναμενόμενο για τους επισκέπτες και δεν θίγει τα δικαιώματα και τις ελευθερίες τους.

4. Αποδέκτες δεδομένων

  1. Τα προσωπικά δεδομένα κοινοποιούνται σε εκτελούντες την επεξεργασία με τις κατάλληλες συμβάσεις, όπως παρόχους φιλοξενίας και λειτουργίας ιστοτόπου, υπηρεσιών πληροφορικής, μάρκετινγκ και δημοσίων σχέσεων.

5. Διαβίβαση δεδομένων σε τρίτες χώρες

  1. Τα προσωπικά δεδομένα δεν θα υποβάλλονται σε επεξεργασία σε τρίτες χώρες.

6. Δικαιώματα των υποκειμένων των δεδομένων

  1. Κάθε υποκείμενο δεδομένων έχει:
    1. Δικαίωμα πρόσβασης (άρθρο 15 ΓΚΠΔ): επιβεβαίωση της επεξεργασίας, πρόσβαση στα δεδομένα και πληροφορίες για τους σκοπούς, τις κατηγορίες, τους αποδέκτες, τη διάρκεια διατήρησης ή τα κριτήριά της και τα δικαιώματα διόρθωσης, διαγραφής, περιορισμού και εναντίωσης.
    2. Δικαίωμα αντιγράφου (άρθρο 15 παρ. 3): δωρεάν πρώτο αντίγραφο· για επόμενα αντίγραφα μπορεί να επιβληθεί εύλογο διοικητικό τέλος.
    3. Δικαίωμα διόρθωσης (άρθρο 16): διόρθωση ανακριβών ή συμπλήρωση ελλιπών δεδομένων.
    4. Δικαίωμα διαγραφής (άρθρο 17): όταν δεν υπάρχει πλέον νομική βάση ή τα δεδομένα δεν είναι αναγκαία για τους σκοπούς της επεξεργασίας.
    5. Δικαίωμα περιορισμού (άρθρο 18): εφόσον (α) αμφισβητείται η ακρίβεια μέχρι να επαληθευτεί· (β) η επεξεργασία είναι παράνομη αλλά ζητείται περιορισμός αντί διαγραφής· (γ) ο Υπεύθυνος δεν χρειάζεται πλέον τα δεδομένα, όμως απαιτούνται για νομικές αξιώσεις· (δ) έχει ασκηθεί εναντίωση μέχρι να εξεταστεί η υπεροχή των νόμιμων λόγων.
    6. Δικαίωμα φορητότητας (άρθρο 20): λήψη των δεδομένων που παρασχέθηκαν σε δομημένο, κοινώς χρησιμοποιούμενο και αναγνώσιμο από μηχανή μορφότυπο και διαβίβασή τους σε άλλον υπεύθυνο, εφόσον η αυτοματοποιημένη επεξεργασία βασίζεται σε συγκατάθεση ή σύμβαση.
    7. Δικαίωμα εναντίωσης (άρθρο 21): για λόγους που σχετίζονται με την ιδιαίτερη κατάσταση του προσώπου, κατά επεξεργασίας βάσει εννόμου συμφέροντος, περιλαμβανομένης της κατάρτισης προφίλ. Ο Υπεύθυνος εξετάζει τυχόν επιτακτικούς νόμιμους λόγους ή ανάγκη θεμελίωσης, άσκησης ή υποστήριξης νομικών αξιώσεων· διαφορετικά παύει την επεξεργασία.
    8. Δικαίωμα ανάκλησης συγκατάθεσης: ανά πάσα στιγμή και χωρίς αιτιολόγηση, χωρίς να επηρεάζεται η νομιμότητα της προηγούμενης επεξεργασίας· η επεξεργασία που στηρίζεται στη συγκατάθεση διακόπτεται.
  2. Για την άσκηση των δικαιωμάτων απαιτείται επικοινωνία με τον Υπεύθυνο μέσω των παραπάνω στοιχείων, με προσδιορισμό του δικαιώματος και του αιτήματος.

7. Πολωνική εποπτική αρχή προστασίας δεδομένων

  1. Τα υποκείμενα δεδομένων μπορούν να υποβάλουν καταγγελία στην αρμόδια εποπτική αρχή. Στην Πολωνία αρμόδιος είναι ο Πρόεδρος της Αρχής Προστασίας Προσωπικών Δεδομένων (Prezes UODO), ul. Stanisława Moniuszki 1A, 00-014 Βαρσοβία, Πολωνία.
  2. Επικοινωνία ταχυδρομικά στην ανωτέρω διεύθυνση, μέσω https://uodo.gov.pl/pl/p/kontakt ή στην τηλεφωνική γραμμή 606-950-000.

8. Υπεύθυνος Προστασίας Δεδομένων

  1. Οι ενδιαφερόμενοι μπορούν επίσης να επικοινωνούν απευθείας με τον Υπεύθυνο Προστασίας Δεδομένων της επιχείρησης, ηλεκτρονικά ή γραπτώς, στα στοιχεία της ενότητας 1 σημείο 2.

9. Τροποποιήσεις της Πολιτικής

  1. Η παρούσα Πολιτική μπορεί να συμπληρώνεται ή να ενημερώνεται σύμφωνα με τις ανάγκες του Υπευθύνου, ώστε να παρέχονται στους Πελάτες και Χρήστες αξιόπιστες και επίκαιρες πληροφορίες.

  1. Το Κατάστημα συλλέγει πληροφορίες για τους Πελάτες, τους Χρήστες και τη συμπεριφορά τους μέσω (α) στοιχείων που καταχωρίζονται οικειοθελώς σε φόρμες για τους αντίστοιχους σκοπούς, (β) cookies που αποθηκεύονται στις συσκευές και (γ) αρχείων καταγραφής διακομιστή που συγκεντρώνει ο πάροχος φιλοξενίας για τη σωστή λειτουργία του ιστοτόπου.
  2. Τα cookies είναι ηλεκτρονικά δεδομένα, συνήθως αρχεία κειμένου, αποθηκευμένα στη συσκευή. Συνήθως περιλαμβάνουν το όνομα του ιστοτόπου προέλευσης, τη διάρκεια αποθήκευσης και έναν μοναδικό αναγνωριστικό αριθμό.

11. Ενημερωτικό δελτίο

  1. Ο Πελάτης μπορεί να συναινέσει στη λήψη εμπορικών μηνυμάτων ηλεκτρονικά κατά την εγγραφή ή αργότερα μέσω του Λογαριασμού. Στη συνέχεια λαμβάνει το Newsletter και άλλες εμπορικές πληροφορίες του Πωλητή στο email του.
  2. Η διαγραφή είναι δυνατή οποτεδήποτε μέσω του Λογαριασμού, της σελίδας https://crong.com/el/newsletter.html, του συνδέσμου σε κάθε Newsletter ή της εξυπηρέτησης πελατών.

12. Λογαριασμός

  1. Απαγορεύεται η ανάρτηση ή διαβίβαση παράνομου περιεχομένου, συμπεριλαμβανομένων αξιολογήσεων ή άλλων δεδομένων.
  2. Η πρόσβαση στον Λογαριασμό παρέχεται μετά την εγγραφή.
  3. Κατά την εγγραφή δηλώνονται τύπος λογαριασμού ή φύλο, ονοματεπώνυμο, επωνυμία εταιρείας, NIP, στοιχεία τιμολόγησης και αποστολής, email και κωδικός πρόσβασης. Οι πληροφορίες πρέπει να είναι αληθείς και απαιτείται ανάγνωση και αποδοχή των Όρων του Καταστήματος.
  4. Με τη χορήγηση πρόσβασης συνάπτεται σύμβαση ηλεκτρονικών υπηρεσιών αορίστου χρόνου· ο καταναλωτής μπορεί να υπαναχωρήσει σύμφωνα με τους Όρους.
  5. Η εγγραφή σε μία έκδοση του Καταστήματος παρέχει πρόσβαση και στις λοιπές εκδόσεις.
  6. Ο Πελάτης/Χρήστης μπορεί να καταγγείλει τη σύμβαση ανά πάσα στιγμή με άμεση ισχύ, μέσω email ή επιστολής στα στοιχεία της ενότητας 1 σημείο 2.
  7. Ο Πωλητής μπορεί να καταγγείλει τη σύμβαση εάν διακόψει ή μεταβιβάσει τη λειτουργία του Καταστήματος, σε περίπτωση παραβίασης νόμου ή Όρων ή αδράνειας του Λογαριασμού επί έξι μήνες, με προειδοποίηση επτά ημερών. Νέα εγγραφή μπορεί να απαιτεί έγκριση του Πωλητή.
