Политика за защита на личните данни

1. Администратор на данни и определения

  1. Администратор на личните данни на Клиентите и Потребителите на Онлайн магазина, наричан също Продавач, е FORCETOP Sp. z o.o., телефон +48 690 007 776, полски данъчен номер (NIP) 6182072303, REGON 300726319.

  5. Онлайн магазин е уебсайтът на Продавача на https://crong.com, предоставящ информация за стоките и наличността им и възможност за покупки или поръчване на услуги.
  6. Бюлетин (Newsletter) е информация, включително търговски съобщения по смисъла на полския закон от 18 юли 2002 г. за услугите по електронен път (Държавен вестник на Полша 2020 г., позиция 344), изпращана електронно от Продавача. Абонаментът е доброволен и изисква съгласие.
  7. Акаунт е съвкупността от данни в Магазина и информационните системи на Продавача относно Клиента/Потребителя, неговите поръчки и договори, чрез която могат да се правят поръчки и сключват договори.
  8. ОРЗД (GDPR) е Регламент (ЕС) 2016/679 от 27 април 2016 г. относно защитата на физическите лица при обработването на лични данни и свободното движение на такива данни, с който се отменя Директива 95/46/ЕО.

2. Цели, правни основания и срокове за обработване

  1. За изпълнението на договор за продажба от разстояние Продавачът обработва: (а) информация за правилната работа на услугите, включително IP адрес, бисквитки и сходни технологии, данни за сесията, браузъра, устройството и активността в отделните страници; (б) данни за геолокация при съгласие, за да предлага по-подходящи стоки и услуги; (в) данни, необходими за покупката, като име, фамилия, адрес на фирмата и адрес за кореспонденция, имейл, телефон, NIP, банкова сметка и друга информация, изисквана при поръчката.
  2. Техническите данни не винаги идентифицират Потребителя сами по себе си, но в комбинация с друга информация могат да представляват лични данни и се защитават съгласно ОРЗД.
  3. Обработването за предоставяне на електронни услуги съгласно Общите условия се основава на член 6, параграф 1, буква „б“ от ОРЗД. Когато е приложимо, обработването въз основа на съгласие за определени бисквитки, подобни технологии или геолокация се основава на член 6, параграф 1, буква „а“. Съгласието чрез настройките на браузъра се разглежда според полското телекомуникационно право. Данните се обработват до прекратяване на използването на Магазина.
  4. Администраторът прилага подходящи технически и организационни мерки съгласно член 32 от ОРЗД, като отчита съвременното техническо равнище, разходите, естеството, обхвата и целите на обработването, както и вероятността и тежестта на рисковете за правата и свободите на физическите лица.

3. Маркетингова дейност на Администратора

  1. Администраторът може да публикува в Магазина рекламна информация за стоките и услугите си. Като основание се посочва законният интерес по член 6, параграф 1, буква „е“ от ОРЗД да информира за услугите и промоциите си. Тази информация съответства на разумните очаквания на посетителите и не нарушава правата и свободите им.

4. Получатели на лични данни

  1. Лични данни могат да се предоставят на обработващи лица въз основа на съответните договори, например доставчици на хостинг, поддръжка на уебсайта, ИТ услуги, маркетинг и връзки с обществеността.

5. Предаване на данни в трети държави

  1. Личните данни няма да бъдат обработвани в трети държави.

6. Права на субектите на данни

  1. Всяко засегнато лице има право:
    1. На достъп (член 15 ОРЗД): на потвърждение за обработване, достъп до данните и информация за целите, категориите, получателите, периода на съхранение или критериите за него, както и за правата на коригиране, изтриване, ограничаване и възражение.
    2. На копие (член 15, параграф 3): първото копие е безплатно; за следващи копия може да се начисли разумна такса според административните разходи.
    3. На коригиране (член 16): на поправяне на неточните и допълване на непълните лични данни.
    4. На изтриване (член 17): ако правното основание е отпаднало или данните вече не са необходими за целите на обработването.
    5. На ограничаване (член 18): когато (а) точността се оспорва до проверката ѝ; (б) обработването е незаконосъобразно, но вместо изтриване се иска ограничаване; (в) Администраторът вече не се нуждае от данните, но лицето ги изисква за правни претенции; или (г) е подадено възражение и се проверяват преимуществените законни основания.
    6. На преносимост (член 20): да получи предоставените данни в структуриран, широко използван и пригоден за машинно четене формат и да поиска предаването им на друг администратор, когато автоматизираното обработване се основава на съгласие или договор.
    7. На възражение (член 21): по причини, свързани с конкретното положение, срещу обработване въз основа на законен интерес, включително профилиране. Администраторът преценява дали има преимуществено законно основание или необходимост за установяване, упражняване или защита на правни претенции; иначе прекратява обработването.
    8. На оттегляне на съгласието: по всяко време и без причина, без това да засяга законосъобразността на предходното обработване; обработването въз основа на съгласието се прекратява.
  2. За упражняване на правата лицето следва да се свърже с Администратора чрез посочените контакти и да уточни правото и обхвата на искането.

7. Полски надзорен орган за защита на данните

  1. Засегнатото лице може да подаде жалба до компетентния надзорен орган. В Полша това е Председателят на Службата за защита на личните данни (Prezes UODO), ul. Stanisława Moniuszki 1A, 00-014 Варшава, Полша.

8. Длъжностно лице по защита на данните

10. Бисквитки

  1. Магазинът събира информация за Клиентите, Потребителите и поведението им чрез (а) доброволно въведените данни във формуляри за съответните цели, (б) бисквитки, записани на устройствата, и (в) сървърни регистрационни файлове, събирани от хостинг доставчика за нормалната работа на сайта.
  2. Бисквитките са електронни, обикновено текстови файлове, съхранявани в устройството. Обичайно съдържат името на сайта, срок на съхранение и уникален идентификатор.
  3. Политиката предвижда предварително съгласие за бисквитките и разглежда натискането на „Затвори“ или затварянето на съобщението като съгласие за всички бисквитки.
  4. Предвижда се и избор „Не съм съгласен“ или промяна на настройките на браузъра; това може да повлияе на някои функции.
  5. Бисквитките се управляват от настройките на браузъра или системата, например Chrome, Safari, Firefox, Opera и мобилните браузъри.
  6. За определено обработване чрез бисквитки се посочва законният интерес на Администратора да осигурява качество и сигурност на услугите.
  7. Използват се сесийни бисквитки, които се премахват при излизане от профила, напускане на Магазина или затваряне на браузъра, и постоянни бисквитки, пазени до изтичане на срока или изтриването им.

Категории и динамичен списък с бисквитки

Регистърът включва функционални (необходими), аналитични и рекламни бисквитки, включително от IdoSell/IAI, Google, PayPal, Meta, Google Customer Reviews и Kelkoo. Имената, целите, доставчиците и сроковете се показват в автоматично генерирания от IdoSell списък на страницата за поверителност на избрания език.

11. Бюлетин

  1. Клиентът може да даде съгласие за търговски съобщения по електронен път при регистрацията или по-късно в Акаунта. След това получава Бюлетина и други съобщения на Продавача на посочения имейл.
  2. Отписването е възможно по всяко време чрез Акаунта, https://crong.com/bg/newsletter.html, връзката във всеки Бюлетин или обслужването на клиенти.

12. Акаунт

  1. Клиентите и Потребителите нямат право да публикуват или изпращат на Продавача незаконно съдържание, включително отзиви или други данни.
  2. Достъп до Акаунта се предоставя след регистрация.
  3. При регистрацията се посочват тип акаунт или пол, име, фамилия, фирма, NIP, данни за фактуриране и доставка, имейл и парола; информацията трябва да е вярна. Необходимо е запознаване с и приемане на Общите условия.
  4. С активирането на Акаунта се сключва безсрочен договор за електронни услуги; потребителят може да се откаже съгласно Общите условия.
  5. Акаунтът от една езикова версия на Магазина дава достъп и до останалите версии.
  6. Клиентът/Потребителят може да прекрати договора по всяко време с незабавно действие чрез имейл или писмо до контактите от раздел 1, точка 2.
  7. Продавачът може да прекрати договора при спиране или прехвърляне на услугата, нарушение на закона или Общите условия или липса на активност в Акаунта за шест месеца, със седемдневно предизвестие. Нова регистрация може да се допуска само с разрешение на Продавача.
